Postal truck at fault for hitting me, but company won't pay up!?

Me and my 2 yr old daughter were going to the store, as I was in getting into the left lane a postal truck came out of a shopping center parking lot and hit me, on the driver side fender area. I had the right away and he had a stop sign. It left a huge basketball sized dent and the fender bending into my tire, making it not possible for my car to be driven in fear the metal from the fender could cause a blow out while driving. I have insurance, and since this is a federal truck, they are going about it their own way and do NOT want to pay up. I am so aggravated, has anyone been in a similar accident dealing with this sort of situation and what was the outcome?Postal truck at fault for hitting me, but company won't pay up!?
Ah, this is Governmental Immunity laws at work.



Federal trucks have no insurance. They "self insure", and rely on the governmental immunity laws to protect them. Just like every other way government works, they exempt themselves from the rules that you and I have to follow.



You need to file this claim with your insurer. The feds are ONLY on the hook for your deductible, unless you have no collision coverage. If you have no collision coverage, you STILL need to file with your insurer, to get the declination letter saying you have no collision coverage, and THEN they will pay for your repairs.Postal truck at fault for hitting me, but company won't pay up!?
If there was an accident report filed, then get the vehicle repaired and submit the bill plus the bill for a rental car if needed to the Tort Claims Coordinator at your local district office. Your local post office should be able to give you that information. You could go through your insurance and then they would take care of sending the bill to the postal service for payment, it's up to you.Postal truck at fault for hitting me, but company won't pay up!?
Go through your insurance, and if you owe on the car loan, tell the bank what happened. Did you change lanes in an intersection? These are factors that the government is looking at. If they can find part of the accident that could be considered your fault then you may not get paid at all.
