A friend of mine was in an auto accident with a postal vehicle. They claim they have no insurance, and also bragged that they cannot be sued. I have looked it up but am still not sure if you can still sue for damages because of it government affiliation. The accident was the postal carriers fault, but there was no citation given because the officer had to check with sergeant before giving it to them (he too was unsure of the laws). Any info would be helpful before we start calling lawyers! Can you sue the US Postal Service?
Normally, in order to sue the Postal Service, you have to go to federal court.
However, there is a function in place that you can get restitution from the Postal Service for any vehicle accident or damage.
You need to obtain Form 95.
You can contact the District Office to get this.
Should they stonewall, contact your congressional representative, who can put pressure on the Postal Service.
ALL accidents have to be reported to the Postal Service to make a determination if the carrier should be fired.
Yea you can sue anyone including the government. Can you sue the US Postal Service?
Have your friend get an attorney. They hit our mailbox
2 months ago and never said a word about it. So go get them.
Yes, you can bring a law suit against anyone. You can hire a lawyer and they will do ALL the paper work for you. Otherwise you can go to the court house and bring forth a suit yourself. If you go that route they will give you a form. Then you can hire the SHERIFF for a fee to serve them with a summons. Or have someone who is familiar serve them. Then the court will give you a date. IF THEY DONT SHOW you automatically win and will get the money you are suing for. OR they can come and present counter evidence and the judge will decide. Can you sue the US Postal Service?
I know that the bus drivers are not indemnified. The police are not indemnified. I can't imagine that the mail men are indemnified. Have you insurance company file a claim with the post office. They will probably pay you off in stamps though. Just kidding about the stamps that is. They may not be insured but they do have to pay for damages.
